Mexico Attorney General Discusses Extradition Process for El Chapo

I don't know why the media keeps saying Mexico has refused until now to consider extraditing Joaquin "El Chapo" Guzman-Loera to the U.S. It issued two arrest warrants for his extradition, one in July and one in September, 2015. One was for his San Diego case involving the 1993 Otay Mesa tunnel, and the other was for his 2012 Indictment in the Western District of Texas.

Mexico's Attorney General confirmed this today in a statement.

The statement also describes the various time periods relevant to an extradition proceeding. The defense has the right to challenge extradition, and the process likely will take several months or longer. His lawyer says he has six writs of Amparo pending or granted, and plans to file another, as he was denied access to El Chapo this weekend at Altiplano. One of the writs was dismissed on legal grounds.[More...]

Mexico issues this press release last July:

In response to a formal request for extradition by the Government of the United States, through diplomatic channels leading, and derived from a process of analysis and diagnosis of such request, on 29 July this year, the Attorney General's Office obtained -from Third District Judge of Federal Criminal Proceedings in the Federal District -formal detention order for extradition of Joaquin Guzman Loera.

During the analysis conducted by the PGR it was verified that the application meets the requirements of the Extradition Treaty between the two countries and with the requirements mandated by the Mexican legislation.

Here is the transcript of the Attorney General's statement at the press conference last night, describing those responsible for his second escape, recent efforts to capture him and the details of yesterday's capture.

As to his July, 2015 escape, I filled in the names here. Here's my recap with photos of yesterday's capture.

As to Chicago, a 9th Superseding Indictment was returned in April, 2015 (Docket No. 422) and unsealed in September, at which time the Judge re-issued arrest warrants for El Chapo, his son and El Mayo (Ismael Zambada-Garcia). The docket entry for El Chapo and his son states:

ORDER as to Joaquin Guzman-Loera, Jesus Alfredo Guzman Salazar: The Clerk of Court is directed to re-issue Arrest Warrants for defendants Joaquin Guzman-Loera and Jesus Alfredo Guzman Salazar. The Clerk of Court is also directed to provide the Government with three certified copies of the 9th Superseding Indictment and three certified copies of the Arrest Warrants for Joaquin Guzman-Loera and Jesus Alfredo Guzman Salazar. Signed by the Honorable Ruben Castillo on 9/28/2015. Mailed notice/ (ym, ) (Entered: 09/28/2015)

I would assume Chicago has filed an extradition application by now, but that's just a guess. (Maybe the reason they needed three certified copies and decided to unseal the Indictment was to enable them to submit it to Mexico as part of the application.) Normally I would say it's crazy to think he'd go to San Diego to stand trial in a case brought more than 20 years ago, but since Mexico just extradited one of his co-defendants in that case three months ago, I no longer discount the possibility. Here are more details on the San Diego extradition request. The Government's version of the facts in that case are in this pleading, filed in 1996.

    Sean Penn interviews El Chapo.

    Blurb 1 from article:

"Now, unapologetically, he said: "I supply more heroin, methamphetamine, cocaine and marijuana than anybody else in the world. I have a fleet of submarines, airplanes, trucks and boats."

And a link to the interview in Rolling Stone.

Scary stuff how corrupt Mexico seems to be.

ragebot: "Scary stuff how corrupt Mexico seems to be."

... given that we're by far the primary market for Mexico's drug trade? We facilitate that corruption with our insatiable demand for illicit products from El Chapo's Sinaloa cartel, et al., and then we supply those cartels with arms and other heavy weaponry.

Our own country doesn't deserve to get off that easy.

    the weird get going.

Strangest blurb from the Penn/El Chapo interview:

"The topics of conversation turned in unexpected directions. At one stage, Mr. Penn brought up Donald J. Trump, the Republican presidential candidate; there were some reports that Mr. Guzmán had put a $100 million bounty on Mr. Trump after he made comments offensive to Mexicans. "Ah! Mi amigo!" Mr. Guzmán responded. "

please comment on the Penn interview in the thread about it. This thread is about extradition.  (I know the thread wasn't up when you posted your comments, but now that it is, I'd like comments on the interview to be in the thread about it.)

but it's pretty much a given. Mexico and the US are already negotiating where the trial will be held. It's pretty much been narrowed down to New York or Miami.
